What is included in the basic insurance
In the rental agreement of Mietauto AG, a comprehensive insurance is included. Liability and collision deductible are CHF 3000 per claim (covering damages to other objects and vehicles and to the rented vehicle). The insurance does not cover the transportation of goods and personal belongings of the tenant. Please note: Driving on race tracks, towing, and test drives (without permission from our side), as well as subletting to third parties, is not allowed. Mechanical damage or damage to windshields, tires, underbody, car keys, rims, structures caused by careless or improper use or neglect of the overall height is the responsibility of the tenant. For an additional fee, the deductible can be reduced to CHF 500 per claim.
The fuel is at the tenant's expense
Rentals are exclusive of diesel or gasoline.
Rental vehicles
Mietauto AG reserves the right to make the reservation for a different vehicle make of the same category if the desired model is not available. In general, the reservation does not create a contract between the customer and Mietauto AG. Mietauto AG has the discretion to refuse the rental to individuals.
Liability
Mietauto AG is not liable for any inconveniences or disruptions of any kind. The tenant is also liable when the vehicle is made available to third parties and any potential passengers. If the rental vehicle is returned outside of business hours, the tenant is liable until Mietauto AG has taken possession of it! The rental vehicle must be parked in a way that does not block another vehicle. The tenant is responsible for any disturbances. The tenant is responsible for self-inflicted defects to the rental vehicle (e.g., overloading, clutch, tires, etc.). If the tenant chooses a breakdown service other than Intertour Winterthur, the customer is responsible for the costs! The tenant is liable with their credit card for all costs incurred under this rental agreement, and allows Mietauto AG to charge them directly.
Insurance
The tenant and any authorized driver are covered by a motor vehicle liability insurance. The liability insurance covers personal, property, and resulting financial damages, with the coverage amounts listed below or as agreed upon. Also included is comprehensive, theft, and passenger insurance, as well as an Intertours Winterthur assistance package. The tenant is fully liable for any legal consequences (insurance recourse, negligence, etc.).
Cancellation of the reservation
Single reservations are canceled free of charge. For the cancellation of multiple vehicles (more than 1 vehicle), we charge:
7 days before the start of the rental - 50% of the rental amount 2 days before the start of the rental - 100% of the rental amount.
Termination of the contract
The rental agreement ends immediately and without explicit notice from Mietauto AG if the tenant provides false information to Mietauto AG. In the event of default or bankruptcy. In any case of the termination of the rental agreement, the tenant is obliged to immediately return the vehicle, and Mietauto AG has the right to take possession of the vehicle, even if it is on private property. The costs are borne by the tenant.
Contract extension
An extension of the rental agreement is only possible with the approval of Mietauto AG before the end of the current rental period. An additional deposit must be made, covering the costs of the extended rental period. Mietauto AG reserves the right to refuse an extension without giving reasons.
Compensation for costs
Bank or post repayment CHF 15.00.- Payment by credit card, 3% surcharge. Out of Office Charge CHF 50.00.- Fines outside Switzerland CHF 30.00.- Parking fines CHF 30.00.- Special cleaning as required. Debt collection per step CHF 200.00.- Default interest 5% from the end of the rental.
Special vehicle equipment
Rental vehicles may be equipped with a crash box, a data logger, or a GPS. The tenant accepts the use of data in case of accidents, for vehicle security, and in case of discrepancies. Individual EU countries have different laws regarding the accessories to be carried. The tenant is responsible for complying with these regulations.
Accidents and repairs of technical defects
Repairs are reimbursed, without one's own fault, against a receipt! Not insured or not allowed are: Off-road and off-road driving. Driving outside of Europe. Driving without a required driver's license, learner's driving, towing, and car racing. Damage due to intoxication with more than 0.5%o blood alcohol content, under the influence of narcotics or medication. Damage due to disregarding the minimum height, speeding, negligence, all kinds of disturbances, and war events.
